Middleboro: Town agrees to finish private road
By Alice Elwell
The end is in sight for a dozen homeowners in south Middleboro who have been embroiled in a long running dispute with contractors, which has left their road unfinished.
Two years ago the Planning Board seized the developer’s $210,000 performance bond for Fernway Estates and hired a paving contractor to finish the road.
That lead to more problems when the paving company didn’t follow the work order, and now the homeowners are facing another winter without the town plowing snow from their road.
Recently during a closed door meeting selectmen and the Planning Board were given the choice of suing the paving contractor or using tax dollars to finished the road.
Allin Frawley, chairman of the Board of Selectmen, said the board voted to forgo years of litigation and sided with residents.
Frawley says officials are working to get the road finished.
Frawley expects the matter to be resolved in time for spring town meeting. In the meantime the residents at Fernway Estates remain on the hook for snow plowing.
